8.On-demand Programme: all digitally offered, self-paced programmes provided by Con Amore on an on-demand basis, including on-demand masterclasses and online trainings. A masterclass is an On-demand Programme consisting of modules, concluded with a final exam and certificate, and accredited by SNRO;
9.Registration: the placement of a written or oral (telephone) order, registration and/or assignment with Con Amore and the acceptance thereof by Con Amore;
10.Substitute: the substitute of the Participant as referred to in Article 5 of these general terms and conditions;
11.Instructor: the teacher;
12.In writing: wherever the term ‘in writing’ appears in these terms, it may also be read as ‘by e-mail’;
13.Examination: an exam administered by Con Amore or a third party following a Programme or Continuing Education, or a case presentation assessed by Con Amore or a third party, or the combination of all examinations associated with the relevant Programme or Continuing Education;

1.These general terms and conditions apply to all offers, invoices, quotations, Agreements with Participants, services rendered to Participants for Programmes, Continuing Education or On-demand Programmes, and all other actions carried out by Con Amore in connection therewith, unless parties have explicitly and in writing agreed otherwise.
2.Con Amore is entitled to engage third parties for the performance of the Agreement. When Con Amore engages or involves third parties, these terms and conditions apply.
3.Upon Registration for a Programme, Continuing Education or On-demand Programme on the website of Con Amore or of an intermediary processing the Registration on behalf of Con Amore, the Participant declares to have taken note of these general terms and conditions and to have agreed to them. Even when registering on a website other than Con Amore’s website, the general terms and conditions of Con Amore shall prevail.
4.If a Participant explicitly and in writing rejects these general terms and conditions, Con Amore and the Participant shall subsequently agree on applicable terms explicitly.
5.If one or more provisions of these general terms and conditions are null and void or annulled, the remaining provisions remain in full force. Should one or more provisions lapse, the parties shall consult to replace the null or annulled provisions with new provisions, taking into account as much as possible the purpose and intent of the original provisions.
6.Applicability of any terms and conditions of the Participant is expressly rejected.
1.Moment of confirmation by Con Amore:
a.of Registration on the website of Con Amore;
b.of Registration (on the website of) an intermediary of Con Amore;
c.of Registration by letter.
2.Con Amore may refuse the Registration of a Participant without stating reasons. Con Amore will in any case refuse the Registration if the Participant does not meet the registration requirements (complete registration form, complete payment details), unless an arrangement can be made. If the Participant does not meet Con Amore’s registration requirements, the Participant must consult with Con Amore. By agreeing to these general terms and conditions, the Participant declares to meet the registration requirements for the Programme, Continuing Education or On-demand Programme and other programme-specific requirements as stated in the Education and Examination Regulations.
3.Offers made by Con Amore are valid for the period during which they are published on the website.
4.In the event of insufficient registrations, Con Amore reserves the right to cancel the Programme or Continuing Education or to merge groups. This paragraph does not apply to On-demand Programmes. If Con Amore intends to cancel or merge, Con Amore will notify the Participant as soon as possible.
5.For On-demand Programmes: upon purchase, you have unlimited access to the programme for as long as it is available in Con Amore’s learning environment. Con Amore reserves the right to modify or remove a programme from its offering. If this occurs, you will be notified at least 30 days in advance. After removal, the right of access expires and no refund will be provided.
6.Amendments to the originally concluded Agreement between the Participant and Con Amore are only valid once accepted in writing by both parties via an additional or amended Agreement. Con Amore is not bound by an acceptance that deviates from the offer, unless Con Amore has explicitly accepted such deviation in writing.
7.If the Participant fails to pay an invoice or instalment on time, the full outstanding amount of the Programme, Continuing Education or On-demand Programme becomes immediately and entirely due, regardless of any agreed payment arrangements. Con Amore is in that case entitled to charge statutory interest and extrajudicial collection costs in accordance with applicable legislation. Any legal costs shall also be borne by the Participant.
1.Invoices and quotations state:
a.the main characteristics of the Programme, Continuing Education or On-demand Programme;
b.the full address and contact details of Con Amore, including telephone number and email address;
c.the total price of the Programme, Continuing Education or On-demand Programme excluding VAT, the total VAT amount, and the total amount including VAT;
d.if applicable, delivery costs;
e.the method of payment;
f.the VAT identification number of Con Amore;
g.the Chamber of Commerce identification number of Con Amore;
h.the invoice number;
i.the invoice date;
j.the name and address of the Participant.
2.Prices stated in the offer, the Agreement or these general terms and conditions are exclusive of VAT and other government levies, unless stated otherwise.
3.The Participant must pay the full amount of the Programme, Continuing Education or On-demand Programme in one payment, unless payment in instalments has been agreed.
4.The Participant must transfer the invoice from Con Amore within 14 calendar days (10 business days) of the invoice date via the payment method selected at registration and in the currency invoiced. In the case of a late Registration where the period until commencement is less than 14 calendar days (10 business days), the invoice must be paid before commencement. If the invoice amount is not paid in full within this period, the Participant is automatically in default, unless otherwise agreed in writing.
5.If the Participant fails to pay the invoice amount within the set period, Con Amore will send a written reminder. If Con Amore must issue a further demand, Con Amore will charge reminder costs of €25. If the Participant remains in default after the demand, Con Amore is entitled to engage a legal service provider (e.g. a collection agency). At that point, the Participant also bears the costs of legal services, court and extrajudicial costs, statutory interest, and any damages caused by the default.
6.If a quotation or invoice contains an obvious error or typo that the Participant can reasonably understand as such, Con Amore cannot be held to the terms of that obvious error or typo.
7.In the event of purchasing multiple Programmes, Continuing Education sessions or On-demand Programmes, Con Amore may grant a discount. The prices in Con Amore’s quotation are closely interrelated. Con Amore is not obliged to perform part of the quotation at a proportional part of the stated price, unless explicitly agreed otherwise.
8.In limited circumstances, Con Amore may change the price of the Programme, Continuing Education or On-demand Programme. Price changes generally apply only to future Agreements, unless one or more of the situations mentioned in the next paragraph apply.
9.Price changes may occur:
a.if Con Amore is required to change the content of the Programme, Continuing Education or On-demand Programme based on requirements for the award of the diploma, certificate or transcript;
b.upon supplementation of the Agreement;
c.when the Participant agrees with Con Amore on an extension or prolongation of the Programme, Continuing Education or On-demand Programme;
d.when, three months after conclusion of the Agreement, changes occur in legislation and regulations applicable to Con Amore.
10.Under special circumstances, Con Amore may add credits to a Participant’s account. A credit can be applied as a discount of one euro on a product. If the Participant wishes to use Con Amore credits, the Participant must indicate after Registration that they wish to apply the credits as a discount on the invoice. Credits cannot be paid out in cash retroactively.
1.The Programme or Continuing Education can only be cancelled in writing. A de-registration is only official once the de-registration form has been completed by the Participant and confirmed in writing by Con Amore. Without this confirmation, the registration and the associated payment obligation remain in effect. For On-demand Programmes, cancellation is not possible once the registration is completed and the material has been made accessible.
2.In the event of cancellation of a Programme, the Participant must return any study materials received unopened.
3.The Participant may dissolve the Agreement free of charge within 14 calendar days from the date the Agreement was concluded, provided the Programme or Continuing Education has not yet commenced. The Participant may dissolve the Agreement by sending a written cancellation to Con Amore within 14 calendar days. For On-demand Programmes, the right of withdrawal lapses once the registration is completed and the material has been made accessible, regardless of the 14-day period.
4.In the event of cancellation of the Programme or Continuing Education, the reasonable portion of the fee due depends on the period until the commencement of the Programme or Continuing Education. The costs the Participant owes after cancellation depend on when Con Amore is notified. The Participant remains liable for the following costs:
| Time of cancellation (Programme) | Costs due (Programme) |
| More than 2 months in advance | 10% of tuition fee |
| From 2 months in advance | 25% of tuition fee |
| From 1 month in advance | 50% of tuition fee |
| From 2 weeks in advance | 75% of tuition fee |
| From 1 day in advance | 100% of tuition fee |
| Time of cancellation (Short Course) | Costs due (Short Course) |
| More than 2 months in advance | 25% of tuition fee |
| From 2 months in advance | 25% of tuition fee |
| From 1 month in advance | 50% of tuition fee |
| From 1 week in advance | 75% of tuition fee |
| From 3 days in advance | 100% of tuition fee |
5.This paragraph applies exclusively to Programmes. If, by your 12th scheduled lesson, you have not attended all lessons or completed all examinations, this is considered a study delay. A maximum study delay of 12 months is permitted. Within these 12 months, you may resume your studies after the delay. It is also possible to pause your studies for a maximum of 12 months. These 12 months are counted by default from lesson day 12 of the class you registered for, even if you pause earlier. After 12 months, the right to reschedule and/or make up lessons expires. It will no longer be possible to obtain your diploma. If you still wish to obtain it, you may re-register for the programme (the associated registration fee must be paid again). Study delays and pausing are subject to change fees: €25 per lesson rescheduling.
6.This paragraph applies exclusively to Programmes. If the Participant discontinues the Programme during the course, no refund will be provided.
7.This paragraph applies exclusively to Programmes. In the event of partial cancellation of a Programme by the Participant, the Participant remains liable for the full tuition fee for the Programme. Amounts already paid shall be deemed compensation for costs incurred for the venue, the Instructor, the provision of study materials, the unfilled spot in the Programme, and Con Amore’s invested time, and are to the extent permitted by law not recoverable.
8.This paragraph applies exclusively to Programmes and Continuing Education. In the event of absence or non-participation in a Programme or Continuing Education, the Participant remains liable for the full tuition fee.
9.This paragraph applies exclusively to Programmes and Continuing Education. In the event of serious force majeure or circumstances on the part of the Participant, the Participant may consult with Con Amore regarding rescheduling of the Programme. The Participant and Con Amore may agree that the Participant follows the Programme at a later date. The following costs apply when changing the Programme or Continuing Education to a different start date (see table below):
| Time of change (Programme) | Costs due (Programme) |
| More than 2 months in advance | €25 per remaining lesson day |
| From 2 months in advance | €25 per remaining lesson day |
| From 2 weeks in advance | €25 per remaining lesson day |
| From lesson day 1 | €25 per remaining lesson day |
| Time of change (Short Course) | Costs due (Short Course) |
| More than 2 months in advance | €25 |
| From 2 months in advance | €25 |
| From 1 month in advance | €25 |
| From 1 week in advance | €50 |
| From 3 days in advance | €75 |
10.This paragraph applies exclusively to Continuing Education. Failing to attend a Continuing Education session without prior cancellation automatically results in the full costs being charged. The Continuing Education can no longer be changed or rescheduled. If the Participant wishes to reschedule the Continuing Education, a new session must be purchased.
11.This paragraph applies exclusively to Programmes and Continuing Education. If a Participant is unable to attend a Programme or Continuing Education, the Participant is only authorised to send a Substitute in their place with the consent of Con Amore, provided this is communicated at least 30 calendar days before the start of the Programme or 1 week before the start of the Continuing Education, and provided the Substitute meets the registration requirements. Con Amore may charge €150 excl. VAT for administrative costs and replacement of certificates or diplomas when substitution occurs shortly before commencement.
12.This paragraph applies exclusively to Programmes. If the Programme has already commenced, substitution is not possible.
13.This paragraph applies exclusively to Programmes and Continuing Education. If the Participant explicitly agrees in advance of the dispatch of study materials to an earlier start of the Programme or Continuing Education through earlier delivery of study materials, Con Amore may, if it considers this possible and desirable, send materials earlier.
14.This paragraph applies exclusively to Programmes and Continuing Education. Con Amore reserves the right to cancel the Programme or Continuing Education if it receives fewer than the minimum number of Registrations. Con Amore will in that case offer an alternative class or dissolve the Agreement. If the Participant cannot or does not wish to participate at another location, Con Amore will refund the tuition fee.
15.This paragraph applies exclusively to Programmes and Continuing Education. Changing the Programme or Continuing Education to a future date at the last moment is financially more advantageous than immediate cancellation. Con Amore wishes to help the Participant follow the programme at a later date against change fees, without cancellation fees. If the Participant reschedules the Programme or Continuing Education but later decides to cancel anyway, two variants of cancellation costs apply:
a.The cancellation costs apply to the new start date of the Programme or Continuing Education, provided these cancellation costs are at least equal to those that would have applied if the Programme or Continuing Education had been directly cancelled at the time of the change.
b.The new cancellation costs are lower than they would have been if the Participant had cancelled directly at the time of the initial change. In this case, Con Amore applies the cancellation costs that would have applied at the original date of change.
16.This paragraph applies exclusively to Programmes. If the student pauses the Programme or incurs a study delay, and the Programme is subsequently discontinued, changed or not rescheduled, there is no right to (partial) refund of tuition fees. The student bears full responsibility for the risk of changes to or discontinuation of the Programme during the pause or delay period.
17.Upon purchase of a home study (digital content of the MBK, PsBK or WMF programme), the consumer explicitly consents in advance to immediate delivery of the digital content. The consumer thereby acknowledges that the right of withdrawal lapses once the registration is completed and the material has been made accessible. Cancellation after purchase is therefore not possible, and 100% cancellation costs apply with no refund.
18.This paragraph applies exclusively to Programmes and Continuing Education. The granting of an exemption for (part of) the programme does not entitle the Participant to a reduction in tuition fee or other costs. Exemptions do not lead to price adjustments, refunds or discounts, unless Con Amore has decided otherwise in advance, explicitly and in writing.
19.This paragraph applies exclusively to On-demand Programmes. Upon purchase of an On-demand Programme, the Participant explicitly consents in advance to gaining access to the digital content. The Participant thereby acknowledges that the right of withdrawal lapses once the registration is completed and the learning environment has been made accessible. Cancellation after access has been granted is not possible and no refund will be provided.
1.Con Amore will endeavour to perform the Agreement carefully and to the best of its knowledge and ability. Where applicable, Con Amore will provide a suitable learning space, study materials and qualified Instructors. For On-demand Programmes, Con Amore will ensure a functioning learning environment and quality study materials.
2.The parties agree that Article 7:404 of the Dutch Civil Code is excluded. Con Amore has the right to have work performed by third parties for a Programme, Continuing Education or On-demand Programme. When performance of the Agreement was entered into with a specific person in mind, Con Amore is entitled to replace that person with a person of at least the same qualifications.
3.Con Amore retains administrative data for 7 (seven) years. Con Amore retains study materials and any submitted assignments for 1 (one) year.
4.If the Participant wishes to be eligible for a Diploma, certificate or transcript, the Participant must attend all lesson days, submit homework at the indicated times, and successfully complete the normative assessment of knowledge and skills. The exact diploma requirements are set out in the applicable Education and Examination Regulations. Only if the Participant has fulfilled all requirements is Con Amore obliged to award a diploma, certificate or transcript. For On-demand Programmes, the Participant must at minimum have completed all lessons and exercises. For on-demand masterclasses, the final exam must also be successfully completed. The exact certificate requirements are set out in the applicable Education and Examination Regulations.
1.The Participant must attend all lesson days and submit homework at the indicated times. For On-demand Programmes, the Participant must independently work through all lessons and exercises at their own pace.
2.This paragraph applies exclusively to Programmes. In the event of absence during a Programme lesson day without prior notice, €100 may be charged. The Participant must give notice at least 12 hours in advance via the contact form on the website.
3.This paragraph applies exclusively to Programmes and Continuing Education. If a Participant has not answered the homework questions for a Programme lesson day or Continuing Education on time, they may not participate in the lesson. The lesson and examination must be made up at another time and additional costs will be charged. The same rules apply to students who have not completed their homework yet attend the lesson regardless.
4.If the Participant wishes to obtain a Diploma, certificate or transcript, the Participant must attend all lesson days, submit homework at the indicated times, and successfully complete the normative assessment of knowledge and skills. For On-demand Programmes, the Participant must at minimum have completed all lessons and exercises. For on-demand masterclasses, the final exam must also be successfully completed. The exact certificate requirements are set out in the applicable Education and Examination Regulations.
5.Con Amore requires certain data to perform the Agreement. The Participant ensures the timely provision of the data required by Con Amore, such as name and address details. If the Participant fails to provide data on time, Con Amore has the right to suspend the Agreement. If extra costs must be incurred due to the delay, Con Amore may recover these costs from the Participant.
6.If the required data contains errors and those errors lead to inaccuracies on printed and/or published material or inaccuracies on a transcript, certificate or diploma, the Participant must bear the printing and/or publication costs. Con Amore will not charge for the work required to correct inaccuracies on printed and/or published material.
7.The Participant is required to communicate changes to contact details in a timely manner. If the Participant fails to do so, Con Amore will endeavour to make contact. Con Amore is not liable for damages if study materials, schedules or other data do not reach the Participant because the Participant has left incorrect, incomplete or outdated contact details.
8.The Participant is required to behave appropriately during sessions and to follow the Instructor’s instructions. If the Participant fails to do so, this constitutes a breach of the Agreement.
9.This paragraph applies exclusively to Programmes and Continuing Education. The Participant is required to behave appropriately during Examinations and must follow the Instructor’s instructions during Examinations. If the Participant fails to do so, this constitutes a breach of the Agreement.
10.The Participant must submit homework digitally via the method made available by Con Amore. If the Participant fails to do so, this constitutes a breach of the Agreement.
11.This paragraph applies exclusively to Programmes and Continuing Education. Since the Programme or Continuing Education must meet certain requirements, the Participant must attend Programme or Continuing Education days to be eligible for the diploma, and must submit homework within the timeframe and in the manner specified by Con Amore to be eligible. If a Participant has failed to do so, Con Amore may deny the Participant access to the lesson. Con Amore will in that case offer the Participant the opportunity to make up the lesson at a later time. If making up the lesson in a parallel group is not possible, the Participant may make up the lesson in the next period in which the lessons are scheduled.
12.This paragraph applies exclusively to Programmes and Continuing Education. The Participant must follow Con Amore’s instructions for the submission of homework, including the format of the document (e.g. .doc or .pdf) or the font.
13.This paragraph applies exclusively to Programmes and Continuing Education. If Con Amore sets deadlines for the submission of homework, the Participant must observe these deadlines.
14.The submission of homework assignments may be a requirement for obtaining a transcript, certificate or diploma. Failure to submit homework assignments (on time) may result in Con Amore not awarding the transcript, certificate or diploma. The full course fee remains due in the event of failure to meet the diploma requirements.
15.If Con Amore identifies academic fraud or irregularities, Con Amore will declare the examination and the associated grade invalid. If the Participant wishes to be eligible for a certificate or diploma, the Participant must retake the examination and lesson day. Retaking a lesson day incurs additional costs. Academic fraud or irregularities include:
a.any form of obtaining information from a fellow student during the examination, whether or not with their consent;
b.having notes, literature or electronic devices within reach. Responsibility for the absence of such devices lies with the Participant;
c.providing or soliciting information from fellow students;
d.photographing examinations or removing examinations from the room.
1.The Agreement ends upon the conclusion of the Programme, Continuing Education or On-demand Programme.
2.If the Participant successfully completes the Programme, Continuing Education or On-demand Programme, the Agreement ends upon the award of the associated diploma, certificate or transcript.
3.Con Amore is entitled to terminate an Agreement if the Participant fails to comply with the Agreement, including these general terms and conditions. Examples of non-compliance include non-performance, improper performance or incomplete performance. The Participant is required to behave appropriately during sessions and to follow the Instructor’s instructions. If the Participant fails to do so, this constitutes a breach of the Agreement. Con Amore will always notify the Participant when it intends to use this measure. The costs associated with the Programme, Continuing Education or On-demand Programme and the obligation to pay remain in effect, and the tuition fee therefore remains due.
4.In the event of the Participant’s bankruptcy, Con Amore is entitled to suspend or dissolve the Programme or Continuing Education of the Participant, unless the trustee of the Participant provides security for Con Amore’s commercial prices.
1.If Con Amore and the Participant agree on a deadline, this shall never constitute a strict deadline. If Con Amore provides a delivery indication for study materials, this shall never constitute a strict deadline. If Con Amore exceeds a (delivery) deadline, the Participant must first give Con Amore written notice of default and provide a reasonable period to fulfil the Agreement.
2.If a (delivery) deadline is exceeded, the Participant’s obligation to take the Programme, Continuing Education or On-demand Programme remains in effect. The Participant may send the notice of default to Con Amore in writing.
3.This paragraph applies exclusively to Programmes and Continuing Education. If the Participant explicitly agrees in advance of the dispatch of study materials to an earlier start of the Programme or Continuing Education through earlier delivery of study materials, Con Amore may, if it considers this possible and desirable, send the materials earlier. By agreeing to earlier delivery of study materials, the Participant also declares to waive the right of withdrawal.
4.Delivery occurs when Con Amore grants access to the delivered material. This takes place via an email with login credentials, unless more or less has been agreed.
1.If Con Amore is held liable, Con Amore is only liable to the extent regulated in this article, unless the damage is attributable to intent or gross negligence.
2.Con Amore is not liable for damage resulting from incorrect or incomplete provision or concealment of data by the Participant.
3.Con Amore is never liable for products or services provided free of charge by Con Amore.
4.Con Amore and the Participant agree that Con Amore will conduct the Programme, Continuing Education or On-demand Programme to the best of its knowledge, but that Con Amore cannot be held liable for damage to the Participant directly or indirectly resulting from the (content of the) Programme or Continuing Education. Con Amore is not liable for damage resulting from application.
5.The Participant must indemnify or hold harmless Con Amore against claims by third parties for compensation.
6.If Con Amore could be held liable, liability shall be limited to a maximum of twice the invoice value of the assignment, unless the liability concerns a part of the assignment. If Con Amore could be held liable for a part of an assignment, liability is limited to a maximum of twice the invoice value of that part of the assignment.
7.Con Amore is not liable for indirect damage, such as consequential damage, business damage, loss of profit, damage due to business interruption and/or other forms of indirect damage, except in cases of intent or gross negligence. Con Amore is not liable for damage to or by third parties.
8.If Con Amore has no influence over developments at third parties, for example those whose location Con Amore uses for the performance of the Agreement, such as a Programme or Continuing Education location, and if those developments lead to damage, Con Amore is not liable. For On-demand Programmes, Con Amore is not liable for technical failures of the learning environment or of third parties whose services Con Amore uses, to the extent that Con Amore has no influence over these.
9.Con Amore, to the extent it can be held liable at all, is not liable for damage arising from medical or psychosocial advice or advice of any other nature given by the Instructor. Advice given by the Instructor is not provided on behalf of Con Amore but by the Instructor personally.
10.Con Amore, to the extent it can be held liable at all, is only liable for direct damage. All damage that is not direct is indirect. Direct damage includes:
1.the costs of establishing the damage;
2.the reasonable costs incurred by the Participant to require Con Amore to perform, unless these costs cannot be attributed to Con Amore;
3.the reasonable costs incurred by the Participant to prevent (greater) damage. The Participant must demonstrate that these costs have led to a reduction in damage.
1.All intellectual property rights associated with the Agreement and belonging to the Programme, Continuing Education or On-demand Programme are vested in Con Amore and remain the property of Con Amore. This includes intellectual property arising from study materials that Con Amore has developed, delivered or made available, including study materials, advice and any blogs on the Con Amore website.
2.The Participant acquires a non-transferable right of use of the study materials for the duration of the Agreement. For On-demand Programmes, the right of use continues for as long as the learning environment is accessible. The right of use covers use of the study materials for private purposes.
3.This paragraph applies exclusively to Programmes and Continuing Education. Con Amore is entitled to use photo or video recordings of Participants for promotional purposes, provided that no strictly confidential information of the Participant is disclosed, unless otherwise agreed in writing.
4.The Participant is not permitted, alone or in collaboration with third parties, to develop or provide a similar Programme, Continuing Education or On-demand Programme based on the Programme, Continuing Education or On-demand Programme provided by Con Amore, developed curricula and associated study materials, unless Con Amore has given written permission to do so.
5.The copyright of these general terms and conditions belongs to Thomas Vegting and may not be taken over, copied or distributed without his permission.
1.If a case of force majeure arises, Con Amore is obliged to notify the Participant as soon as possible. Con Amore will endeavour to continue and complete the Programme, Continuing Education or On-demand Programme, or to continue or complete it at a later date.
2.In the event of force majeure, Con Amore is entitled to suspend the Agreement for a maximum of 6 months without judicial intervention and without incurring any liability, or to dissolve it. If the force majeure lasts longer than 6 months, both parties are entitled to dissolve the Agreement free of charge and without liability.
3.Force majeure in these terms is understood, in addition to the statutory interpretation and interpretation in Dutch case law, as an external cause (foreseeable or unforeseeable) over which Con Amore has no influence and as a result of which Con Amore cannot reasonably be required to perform. Examples include a strike by third parties, loss of a lesson location, or physical incapacity of an Instructor. For On-demand Programmes, an example of force majeure is the loss of the learning environment due to a failure at an external provider.
4.Con Amore is entitled to invoke force majeure even during a period in which Con Amore should already have performed its obligation.
5.If it is not possible for Con Amore to continue or complete the Programme, Continuing Education or On-demand Programme, both parties may dissolve the Agreement. Tuition fees already paid will be refunded on a pro-rata basis based on the number of lessons and the registration fee. Con Amore may invoice at the time of dissolution for the portion of work already performed, proportional to the agreed price. Tuition fees already paid will only be refunded on a pro-rata basis if the student follows the programme according to the original schedule and there is no pause or study delay. If the student makes use of a pause or delay arrangement and the programme is discontinued or not rescheduled during this period, no refund will be provided.
1.If the parties disagree, they commit to reaching a new agreement as quickly as possible by speaking honestly, openly and in good faith, with a sense of fairness for all involved.
2.If the parties are unable to resolve a dispute among themselves, their next option is to convene a mediation or collaborative law process.
3.Dutch law applies to all offers made to the Participant and Agreements concluded between the Participant and Con Amore.
4.In the unlikely event that a dispute still exists after carrying out paragraphs 1 and 2 of this article, the competent court in Midden-Nederland, including the summary proceedings judge, is competent to take cognisance of disputes arising from legal relationships between the Participant and Con Amore or from offers by Con Amore.
5.Con Amore may amend these general terms and conditions. New general terms and conditions will be announced by displaying them before logging into the learning environment, where they must be accepted.
1.Con Amore and the Participant are both obliged to handle confidential information received from each other with care. Information is confidential when one of the parties indicates it is confidential upon providing it, or when confidentiality follows from the nature of the information.
2.Con Amore is entitled to engage third parties to perform the Agreement. Con Amore will only provide third parties, such as Instructors, with the data necessary for the performance of the Agreement or for security.
3.This paragraph applies exclusively to Programmes. For the purpose of performing the Agreement, particularly in the context of exercising the Agreement, Con Amore provides the contact details of Participants to other Participants in the same group for activities such as travelling or studying together.
4.After obtaining contact details of fellow Participants, the Participant undertakes to refrain from, among other things:
a.distributing spam, including defamatory statements or texts;
b.distributing material contrary to public order and decency, such as messages of a pornographic and/or racist nature;
c.infringing the rights of third parties, including: i. copyrights; and ii. the privacy of third parties;
d.criminal conduct.
5.Con Amore is entitled to use the Participant’s data for sending study materials, the Con Amore newsletter, information about Programmes or Continuing Education offered by Con Amore, or other information about Con Amore’s activities. The Participant may unsubscribe from any mailing at any time by sending a written cancellation to Con Amore.
6.A party is not obliged to pay compensation or indemnification when a party discloses confidential information to third parties without the other party’s consent on the basis of law or a court order.
7.Other disclosure of confidential information to third parties is only possible with the consent of the other party.
8.Con Amore uses Social Media for promotion and/or publicity. Con Amore has the right to post photos or videos of Programmes or Continuing Education sessions. If the Participant objects to this, the Participant may notify Con Amore in writing before and during the Programme or Continuing Education. Con Amore will, if reasonable, remove the photo. Unreasonable is in any case demanding removal of a photo in which the Participant is not recognisable.
1.Con Amore will publish these general terms and conditions on their website and is happy to provide them again upon request, for example in the event of loss.
2.The most recent version of the general terms and conditions applies to every legal act of Con Amore, unless those acts serve to perform an already established Agreement.
